Sorry to hear that.

Is that what the police said? In the eyes of most police, regardless what happens in front of you (someone slams on the brakes, hits someone in front of them, etc) you should leave enough room between you and the person in front of you to stop in time. Of course if a car swerves into your lane, cutting you off, and than slamming on their brakes, that's a whole different story.

If it is indeed the other person's fault, wouldn't their insurance take care of things? Meaning, it doesn't matter if you have collision on your insurance or not. I don't know how things work in New York.

If you rear-end someone it is usually automatically your fault.

You were following too close. It is never ineviteble to hit hit someone. I suspect you will be getting sued from the other 2 drivers. The last one in the back always gets screwed. Expect to get served with a ticket soon.

Not sure how it works in New York, but if he didn't get a ticket at the scene, it's doubtful he'll get a ticket later.

Ouch, that sucks man. Nice to see that you had taken that hideous symbol off the front of your car, too. Let's hope you can work something out in your favour.

Turns out I've been driving around without insurance for the past month and a bit. My payment bounced because of a banking error, and they suspended my insurance. Only thing is. They didn't tell me. Good thing I found out. Now i'm driving my parent's Oldsmobile Cutlass Cierra till I get my mini loan to consolidate my credit card debt etc. and get my insurance off suspension on Monday. That really sucks too because they treat you like some scum baby rapist or something and hike your rates when that happens. .. even though you have a perfect driving record, not a single event, ever.

its not mandatory you just have to have the basics and it was inevitable for me to hit him because he wasnt paying attention and breaked so quick that i couldnt have stopped we were in heavy trffic and there wasnt anywhere to go. The guy in the middle got the tickets for being too close and not paying attention. im not sure if ill get a ticket later though it is possible in new york cuz it happened to my grandma but i hope not i just dont know whats going to happen i hope i can get a nother car soon

Well, I figure if the person in front of you hits something (that slows them faster than their brakes could've and you hit them it's THEIR FAULT. If they brake HARD and avoid hitting anything and you rear end them then of course it's your fault.

Example: How are you supposed to be able to stop when travelling 65MPH and the guy in front of you hits a deer that basically stops his car instantly.........takes a LONG distance to come to a dead stop from 65MPH......imagine everyone left that kind of space......imagine the traffic congestion ALL OF THE TIME!

It's the driver responsability to maintain a safe distance from the car in front on order to be able to stop under any condition. If the driver panic stops to aviod anything and you hit him its your fault. It doesn't matter what the weather is, or how bad the traffic is, or if he hits a deer. You must maintain control of your car at all times or it is careless driving.
