Who is at fault?

http://www.detnews.com/2004/autosins...c03-244362.htm

Quote:
GM said during the trial that Thomas caused the accident by driving too fast in icy road conditions, and he was injured because he didnít wear his seat belt.

Thomas, 33, was ejected from his 1999 Suburban when it flipped over on I-435 in Kansas City and died from a pulmonary embolism. His family, which includes his mother and seven children, sued GM, claiming the Suburbanís roof crushed in on him, causing the paralysis before he was ejected.
Well if he wasn't wearing his seatbelt and was driving fast during icy conditions, that says alot right there. I mean just because it's a large SUV does not mean it's safe.

What's your opinion?

Its the driver's fault for buying a GM.

No seriously....I believe anyone who doesn't wear a seatbelt is taking their own life in their hands. This guy was ejected from his truck. He could have been injured at any point along the way...not neccessarily when his cab was crushed. (and if you think about it...if the cab was crushed before he was ejected, it would be harder for him to be ejected.)

I'd like to see the evidence that the family is using to prove he was killed by the truck's collapse as opposed to him being ejected...not to mention caused by an accident due to poor, unsafe driving in bad road conditions.

If you dont wear a seatbelt, this will happen...they invented and mandated them for a reason...if the roof crushed before he was ejected, he wouldnt have been ejected. Not to mention driving in an unsafe manner during not-so-perfect conditions. My verdict is the driver.

The part on any vehicle that is most prone to failure is the nut that holds the wheel...

My mothers death was due to the lack of a seat belt when she rolled her TJ and was ejected........... I find it funny how people are willing to sue for stupid things example, the lady who got a cup of coffee from Micky D's and put it between her legs while driving got burnt from it and sued Micky D's......... now I dunno bout anybody else but when I buy coffee I WANT IT HOT AND I"D NEVER PUT IT BETWEEN MY LEGS WHILE DRIVING!!!!........ just goes to show that people sue cause of stupidity.

Yikes, Sorry to hear about your mom, I believe that Seatbelts are necesary, and that to own an SUV you should have to learn how to drive one when you buy it, they are not cars, and you cant drive a SUV like a car.

S/SE...sorry to hear about that...seatbelts are one thing that has been jammed into my head since i was little...hopefully you wear yours.

well, GM won which is good...and i find this quote curious:
Quote:
Two of the 12 jurors voted to award damages, including one who is a Chiefs season-ticket holder.
people think that because they are stupid that they have the right to sue the company for not making everything idiot proof

Definitely the driver. It's hard to imagine how he can be crushed by the roof, and then find enough space to be ejected from the vehicle. Besides, he was speeding, with no seatbelt, and rolled over. He would have very likely died anyway. Plus, I don't think that many vehicles on the road can actually withstand a rollover.

Well before my mothers death (R.I.P. 4-1-03) I've always worn my seat belts..... felt odd with out them, since then I've been even more aggressive about it, like on road trips I'll loosen the belt so I can lay sideways in my dads van but I'm still hooked in... where as before I'd just unhook and flop over.

Thanks for the kind words and all I can say is You save yourself and your family lots of pain by wearing your seatbelt EVERYDAY..... wish I knew why my mom didn't that one time.

Don't know whether to believe it or not but if it's true Chrysler is sitting on a powder keg

I cringe when I see a mid 90s General Motors car that has the door mounted seat belts .

What were they thinking when they did that.
