I bought a 93 Intrepid from a relative for $1100. She offered monthly payments for $200. So I had extra money to burn, and already gave her $600 in about two months. Now she says she needs $250 more by Friday, or the guy that she bought the car from will try taking it. I wasn't told this crap until after I bought it, and I can get her half of that this Friday, and the other half next week. What pisses me off is, this is her problem, she offered monthly fees, and I been loyal to that, she tells me this crap now, and I'm financially broke, paying for school, and have a credit card bill maxed out nearly. Should I just give her the money, and hope for the best, or should I demand all my money back, and bring the car back. I'm just pissed, that I'm basically being painted in a corner, and these wings on my back keep growing more.

Does the guy she bought it from know that she has sold it to you and are you sure shes been making the payments to him on time?

i say keep to your word and give her the original agreement of 200$ monthly.

Otherwise tell her the deal is off an she can have the car back for the money that you already gave her.

its kind of unfair to her and the original seller of the car since you have been using the car for the past two months but thats her only choice. If i were her i would have paid the car in full be fore selling it to you.

You went wrong in several instances here.

1 - NEVER buy a car from family.

2 - You said you had extra money to burn, yet you say you're financially broke, and a credit card bill that's almost maxed out. Sounds like you need to re-think your financial perspective a bit.

3 - Never finance anything unless it's from a bank or somebody you ABSOLUTELY TRUST.

The "corner" you're being painted into exists partially because of poor decision making.

I say if u have the title then just make the payments to her as promised. To me it sounds like she isn't making aný payments to the orignal owner. If u give her the car back u will have no car or no money! U and me both know she doesn't have ur money. She either gave it to the guy or spent it. She most likly spent it, because if the guy wanted higher payments, then she would of made u pay more. Tought call bud, keep us updated!

Was there any type of written contract involved?

Sounds like she doesn't even own the car. From what you said in your 1st post, it's looking like she's on some payment plan with the previous owner, and tried to get out of it by passing the buck to you. It really all comes down to who has the title. If you have it, continue the agreed upon payment schedule and let her sort out her problems. The previous owner would be a jackass to commit a felony (grand theft auto) over a $200/month '93 Intrepid. I would keep an eye on the car however.
Is she or the previous owner has the title, i would trade the car back to her for the amount you've already paid, in cash, and wash your hands of what seems to be a huge mess.
And as LOUD said, never buy cars from family.

Thanks guys, no she doesn't own the car. She didn't inform me until after I bought it though. I have the title, so I don't think it's like the guy can come take the car now, but I don't need authorities involved, and him coming around my house. For now I just told her I'll give her $250 more, but that's all. If she tries giving me crap after that, it'll come out one ear and out the other.

Well if you have the title and it doesn't show a lien then the guy who sold it to your Aunt made a bigger mistake then you did-in your favor.

I know by law in my area the guy can sue your aunt for the balance but because he signed the title without a lien against it, he wouldn't be able to take any action to recover the car.

Call your DMV to find out your local law's, you should be in the clear.

Is the title still in the previous owners name or your aunt's? Either way, if it's been signed by the other party, you should be all set. This is basically like the receipt for the car. I don't know all the rules/laws, but you should be in the clear. I would run it past the SOS just to be sure you're in the clear. Just make sure you're locking the doors and maybe pulling the fuse to the fuel pump...in case the guy is nuts.

I have the title.
He said in the post above that he has the title. Hell I wouldnt pull any fuses I would just keep the vin number and license plate number on you, so if he does steal it call the cops for theft. Possession is nine tenths of the law

i'm in the process of selling my truck...the guy wanted to make payments so I said sure as long as i'm in possession of vehicle and title until paid off. Currently I've been happily sitting on the first of the cash and am waiting for the rest. No worries here
