I was at the local minimart waiting on a lexus backing out and BLAM!! a mustang decides to get fresh. The kid gets out(22 yrs. old) and says "I'll give you my cell number and I'll buy you a new bumper and put it on". I said fu** that. I then said he should get his insurance info which he said "I don't have insurance" I then said "I will have to call the cops" to which he replied "why the hell you gotta call the cops". I gladly replied "because i'm not getting burned by some fu**ing c**ksucker like you". Cops came, kid had Florida tags, and no insurance. The cop said he could not site him due to the minimart being private property, and i may get screwed paying for the repair. They did say he still had a chance of being charged for no insurance but were unsure. THe odd thing is the cops gave back our info and then drove off. The kid parked his car in the lot to talk to what looked like his father. How did he not get towed the hell away? What am I to do now? I have a really hard time sucking up a $250 deductible due to a wreck from an uninsured prick. My wife thinks I am over reacting but at this point I am thinking about sueing the prick for repair bills regardless of what she thinks. I am getting fed up with people digging into my pocket due to their lack of responsibility. Any opinions or advice would be great.
Damage was not to bad. He knocked out my passenger side fog light, scratched and gouged the bumper skirt, and when he pushed in on it he pulled it out from under the fender. No fender damage. Odd thing is it goes in the shop next week for a new hood from a deer I hit a month or so ago. They are painting the hood and blending it in to the fenders.

Talk to your insurance. If they want to take it to court they can sue and win and you'll wind up getting your deductible mailed back to you in the form of a nice fat check from the insurance company.

More often than not the insurance company will go after the little twerp.

I don't know where you live but here in AZ you can't even get insurance without having uninsured motorist coverage. The cops couldn't even site him for a suspended license? I think all states now suspend your license if you can't show proof of responsibility i.e. insurance. I know the cops don't usually respond to accidents occuring on private property but they sure as hell will issue a citation on private property.

I went through this a few months back, but the driver also had no license and the insurance card he showed the cops was fraudulent. I was lucky. As part of an unisured motorists claim investigation my insurance company found a valid policy on the other vehicle. I was able to file a claim directly with the other company and paid nothing out of pocket.

If you have full coverage or unisured motorist just file the claim with your own insurance company. You can then sue the other party in small claims court for your deductible. Since you are insured, I doubt you will be able to sue for the total cost of repairs, only what you pay out of pocket. Your local laws may differ, so it would be wise to check it out. If he's from out of state I wouldn't hold my breath for him to show up to court anyway.

You can also go to the kid and his father and tell him to pony up your $500 deductible (you deserve a little something for your trouble) and maybe he'll do the right thing. I wouldn't count on it, though. The kind of person who drives around without liability insurance usually knows very little about doing the right thing.

I understand how you feel. I too was furious. Your wife is probably right, though. You may just end up taking a $250 bite out of an excrement sandwich. It sucks that some people don't take responsibility for their actions, but that attitude seems to be running rampant these days.

BRW, the cop let the guy who hit me go free as well. I would have expected some kind of arrest for driving without a license, but apparently not. The cop just drove away, leaving the unlicensed driver to get right back into the car and drive away. I don't get it.

Good luck, and try to look on the bright side. No one got hurt and that's what is truly important.

It really erks my a$$ to know this prick could have pulled out and possibly killed a mother and a child all because the law did jack sh!t to prevent it. Then what, someones life gets turned upside down due to a few bs laws. The law never ceases to amaze me when it comes to this sort of thing. My wife did a background check on him so to speak and his track record is quite long. By the way PA is the location. I am thinking of mailing him a certified letter stating its pay the deductible or a trip to court.

It would help if you had a witness or someone to back you up. Then you can go to court. The cop was not there so he is a "nobody" at the time.

Thats not true! I do not have unisured motorist coverage, its not a requirement in AZ.

I know this because the wife was involved in a hit and run and we did not have this coverage. So I covered it all out of pocket, and I am now taking it to small claims court.

he admitted to the cop he hit me.

I would like to keep my $250 for deductible. So I knock off work for court to gain what....nothing really. I gotta go to bed, just getting more aggravated.

Well, simply sue his ass. He admitted to you that he hit you, and I'm sure if you can provide some kind of evidence that he did, you should be good to go.

His only evidence is a witness. Other than that, he has to pay the deductible and move on.

Unless there was a witness that was written down in the police report he is 0% at fault.

I did say in the opening that i did call the cops and they showed up. Hopefully the cop did his job through-and-through.

Well when you pretty much know you have a 50/50 chance of getting a little or none at all you gotta use judgement.
